'RHOA' Star Kim Zolciak's Son Kroy Biermann Jr. Remains in Custody Following Arrest — Security Footage Reveals a Key Detail

Kim Zolciak's teenage son remains behind bars days after his arrest, with an investigation that began months earlier and has now drawn attention to evidence gathered along the way. But what happened at the gym — and what investigators later found — is only becoming clear piece by piece.

Kroy Biermann Jr., known as KJ, the 15-year-old son of former The Real Housewives of Atlanta star Kim Zolciak and retired NFL player Kroy Biermann, was arrested August 17 in Alpharetta, Georgia.

According to court documents reported by TMZ, the arrest followed an investigation into an alleged April 23 incident at a Life Time Fitness facility.

The Arrest Came Months After the Alleged Gym Incident

Authorities say the alleged victim was a teenage classmate of KJ's. The incident was reported to police the following day, when an officer was dispatched to North Fulton Hospital after the girl and her father reported an incident.

Police then began investigating what had happened at the gym and gathering information from the people involved. The allegations are disputed, and KJ has not been convicted of any crime.

The Investigation Stretched Into May

After the report was made, investigators began working to establish what happened and to speak with KJ's family. An officer reportedly first attempted to contact Kroy on May 14. Four days later, Kroy spoke with the officer and said he would discuss the matter with Kim, according to the police report.

The investigation also included a medical examination of the alleged victim. The police report states that doctors did not find male DNA in the areas examined, a detail that would later become central to KJ's family's public response.

Kim Was Still Celebrating Her Son Weeks Before the Arrest

The allegations surfaced publicly months after Kim had shared an emotional birthday tribute to KJ. On May 31, she described him as her "most incredible son" in an Instagram post and wrote at length about her pride in the teenager, particularly his work ethic, discipline and dedication to football.

"I had no idea what was missing from my life until you arrived. You changed me in ways I could never fully describe. ❤️ You taught me strength, compassion, patience, and what the mother-son bond truly means."

She added, "You are my heart walking outside of my body, and every day you amaze me. You give the biggest, best hugs, and I am so proud of the young man you have become."

Speaking about his work ethic, she said, "Your work ethic, dedication, discipline, and drive, especially when it comes to football 🏈, are truly admirable."

She concluded her tribute, writing, "Watching you pursue your goals with such determination inspires me. No matter how old you get, you will always be my baby, my greatest blessing, and one of my proudest accomplishments. I am grateful every day that I get to be your mom."

The post came weeks after the alleged April incident and months before news of KJ's arrest became public.

Then Police Made an Arrest in August

KJ was taken into custody August 17 and remains in custody without bond, according to TMZ. The Alpharetta Police Department confirmed that KJ is being charged as an adult. He is expected to appear before a Fulton County Superior Court judge in September for pretrial proceedings, according to FOX 11 Los Angeles.

For KJ's family, however, the arrest is only one part of a case they strongly dispute.

Kim Says Her Son Passed a Polygraph

Kim has publicly rejected the allegations and said KJ denies ever having been involved with the girl or engaging in the conduct she described. In a statement to Page Six and TMZ, the actress said:

"The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged."

Kim also claimed that her son voluntarily took a polygraph examination and passed it. She further said an examination found no DNA belonging to KJ.

"We are also aware that this individual has made similar allegations involving two other people, which raises serious concerns that deserve to be carefully examined."

Kim cautioned against treating an accusation as proof while saying legitimate allegations should still be investigated. "Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation."

KJ's attorney, Jason Sheffield, has also forcefully defended the teenager.

KJ's Attorney Calls Him '100% Innocent'

Jason told Page Six that KJ is "100% innocent and tried to present evidence to the arresting officer, including a passed Polygraph by a notable and respected sex offender Polygrapher, as well as evidence of other prior false allegations by the alleged victim."

He also pointed to the lack of male DNA documented in the police report. "Additionally, the officer’s report notes the GBI found NO male DNA on or inside the areas the alleged victim claimed she was assaulted."

Jason added, "The fact that he’s been arrested and is being held without Bond is a tragedy. He is not only presumed innocent, but is in fact, innocent. I'm asking the Public not to presume the truth of these allegations and to give the families on both sides their space and privacy."

What Police Say Led to the Arrest

The police account provides the fuller explanation behind the charges. According to the documents, the teenage girl told investigators that she was at the gym when she saw KJ, who suggested they go toward a co-ed sauna. To get there, the two reportedly had to walk through a family changing area.

The girl alleged that KJ became physically intimate with her after she told him no and that he continued despite her objections. She further alleged that he forced her to engage in sexual acts against her will.

The allegations resulted in KJ being charged with felony aggravated sodomy and aggravated sexual battery. The case remains disputed, and KJ has not been convicted of any crime. But the allegations were not the only information investigators examined. Security footage from inside the gym provided another piece of the timeline.

Security Footage Reveals a Key Detail

According to TMZ's report on the security footage, an officer reviewed surveillance video from the gym showing the alleged victim arriving at the facility and later spending time with KJ.

The footage reportedly shows the girl leaving the family changing room and heading toward the lobby, while KJ is seen leaving the same changing area and walking alone toward the sauna.

The video does not reportedly show what happened inside the changing area itself. Instead, it provides investigators with a recorded sequence of the teenagers' movements before and after the alleged encounter. Police also reportedly spoke with the girl at the station, where she told investigators that she knew KJ and his girlfriend from school.

She said KJ had previously dated a couple of her friends and had most recently begun dating her best friend, according to the documents. She also told police she blocked KJ and his girlfriend after the alleged incident.

Investigators reportedly obtained permission to download data from the girl's phone, but a broken USB-C port prevented them from extracting the information.

The Charges Carry Serious Potential Consequences

The aggravated sodomy charge is especially serious under Georgia law. The 2022 Georgia Code provides for life imprisonment or a split sentence of at least 25 years and up to life followed by lifetime probation for a person convicted of aggravated sodomy.

The code also contains a specific provision addressing certain cases involving younger defendants and victims. Because KJ is 15 and the alleged victim was also a teenager, the precise application of Georgia's youth-related provisions would depend on the circumstances and how the charges proceed.

At this stage, KJ has been charged, not convicted. He remains in custody as the case moves toward its next court proceeding.
