How McCrary Got to This Point
McCrary's release marks a turning point in a legal saga that has stretched on for years and taken him across state lines. The actor was first arrested in October near Tijuana and held on a no-bail order in San Diego.
Following multiple court hearings, he was extradited to Michigan, where he faced five felony charges — including failing to pay child support and absconding. After months in custody, McCrary reached an agreement to resolve the long-standing case.

Loftin issued a pointed statement on her client's behalf, saying, "Over the last four years, Mr. McCrary's fight for justice and truth has been painted as an attempt to shirk his responsibilities to his child. The resolution reached today makes it clear that family does matter and that it always has."
She also emphasized that the outcome will allow McCrary to "correct the misleading narrative and put this matter behind him."

Meanwhile, Barlow shared insight into McCrary's state of mind following his release, stating that he feels relieved to be heading home for the holidays. Despite the court resolution, Barlow also noted that McCrary still plans to continue fighting to clear his name.
How his Legal Troubles Started
Let's roll back to the moment that reignited his legal troubles — the October arrest that took place under serious circumstances. He was taken into custody by United States Border Patrol agents near the U.S.-Mexico border in California.
He was booked into a San Diego jail, where records indicated he had been apprehended on an out-of-state felony charge.
At the time, the case was classified as a "fugitive arrest," according to California Penal Code designations, which apply to individuals wanted by another state for serious criminal offenses. McCrary was indeed wanted in Michigan, where a warrant had been issued after he failed to appear in court over a child support-related matter.
However, interestingly, according to TMZ, sources close to McCrary's ex-wife, former Harlem Globetrotter Tammy Brawner, later clarified that this recent arrest had no direct connection to the child support agreement between Brawner and McCrary.
Despite this clarification, the October incident added to a history of similar allegations. McCrary had been arrested twice before — once in 2015 and again in 2023 — both times for allegedly failing to pay child support.
The October arrest underscored the mounting financial obligations McCrary was facing, obligations that prosecutors say had reached staggering levels.
Over $75,000 Owed and Counting…
During his extradition hearing, officials revealed that the actor owed more than $75,000 in unpaid child support to his daughter in Michigan as of August 2024.
By the time of his court appearance, they stated, that figure had grown "substantially more." The revelation added weight to the legal action taken against McCrary, painting a clearer picture of why the out-of-state warrant had escalated to a fugitive-level offense.
The Dispute That Lit the Fuse
The growing financial burden traces back to McCrary's protracted and highly contested divorce from Brawner — a legal battle that played out over nearly two years before finally concluding in 2019. At the center of their dispute was custody of their then-three-year-old daughter.
According to court documents, Brawner was awarded both legal and physical custody, while McCrary was granted weekly visitation rights. However, his access to their child came with significant conditions.
The court required McCrary's first 20 visits to be monitored, and he was also ordered to complete a series of corrective steps before gaining unmonitored access. These included attending alcohol and drug abuse programs, enrolling in a batterers' intervention course, and finishing six parenting classes.
Upon completion, he would be eligible for unmonitored visits, though he was still expected to participate in co-parenting classes going forward.

Financially, the agreement obligated McCrary to pay $1,366 per month in child support, though no spousal support was awarded. The court appeared to take Brawner's allegations regarding McCrary's substance abuse seriously, mandating that he submit to two random drug tests within a 60-day period.
Additionally, both parents were prohibited from speaking negatively or derogatorily in front of their child, and neither was permitted to be under the influence of drugs or other substances while caring for their daughter.
A Chilling Allegation Against McCrary
The couple's custody battle was further complicated by a troubling allegation that emerged in 2018, a year before their divorce was finalized. At the time, Brawner accused McCrary of injuring their then two-year-old daughter during a visit, an incident she said left the child in tears and required medical intervention.
According to court documents, Brawner claimed McCrary partially dislocated their daughter's arm after taking her to the bathroom.
Brawner also claimed that McCrary went on the radio, stating that she had been coaching their kid to lie and say that her father had hurt her.
She later provided medical records describing the injury, which doctors identified as Nursemaid's Elbow — a common condition in toddlers and young children that occurs when the elbow is pulled, and one of the bones partially dislocates.
The reports noted that the little girl cried when attempting to move her arm, but responded well after a corrective procedure was performed. McCrary denied intentionally causing the injury, stating he had simply grabbed one of his daughter's hands to lift her up and then quickly supported her with the other.
The incident became a flashpoint in their already tense relationship, with Brawner also accusing McCrary of violating visitation protocols and failing to comply with court-ordered co-parenting classes.

"I cannot co-parent by myself," Brawner said at the time, expressing frustration over what she described as McCrary's unwillingness to meet the court's expectations.
"I have gone above and beyond to parent with Mr. McCrary but [sic] he appears to be too bitter and too much of a tyrant to parent with me," she added. Efforts to reach McCrary for comment at the time went unanswered.
